Elon Musk’s AI startup, xAI, is facing intense scrutiny following a Reuters report revealing that the company installed 59 mobile natural gas turbines to power its Colossus 2 data center without obtaining required federal clean air permits. The massive off-grid setup has triggered a severe environmental justice backlash, as the unpermitted power plant sits adjacent to predominantly Black communities that already suffer from disproportionately high rates of lung disease.
The Scale of Unpermitted Pollution
Connecting massive artificial intelligence infrastructure directly to the traditional power grid can take years. To bypass these delays and rapidly scale the processing power needed to train its Grok AI model, xAI deployed temporary, portable gas turbines. The company and Mississippi regulators initially argued that because the units are mobile, they are exempt from standard permanent permitting rules.
However, environmental experts and legal challenges maintain that the sheer volume of these installations violates the Clean Air Act. The Clean Air Act establishes a strict 100-ton threshold for nitrogen oxide (NOx) emissions before a permit is legally required.
According to emissions estimates modeled from manufacturer profiles, running just 30 of the 59 turbines continuously would release:
- 2,500 tons of nitrogen oxide annually, putting the site on par with the heaviest-polluting gas power plants in the United States.
- 4,000 tons of carbon monoxide per year.
- 22 tons of formaldehyde, a known toxic carcinogen.
While the Colossus facility is tied to Memphis, Tennessee, at least 57 of the 59 offending turbines are stationed just across the state line in Southaven, Mississippi.
Disproportionate Health Impacts
The placement of the unpermitted turbines has drawn sharp condemnation from civil rights and environmental groups, including the NAACP, which previously filed a lawsuit against xAI over clean air violations.
Residential areas adjacent to the area are mostly Black neighborhoods that have already been hit hard by a history of industrial pollution and being redlined. Health authorities say these neighborhoods also have high cases of diseases affecting breathing, like asthma and lung disease, as well as cardiovascular disease, the heart disease. The emission into the air of thousands of tons of particles of smog and harmful chemicals in these areas will further aggravate these ongoing health issues that are already present in those populations.
National Security vs. Environmental Law
The battle over the Colossus 2 power source has escalated into a high-stakes clash between corporate accountability and federal policy.
The U.S. Department of Justice (DOJ) stepped into the legal fray by asking a federal court to dismiss the NAACP’s lawsuit against xAI. The government argued that shutting down or restricting the natural gas turbines would directly threaten American national, economic, and energy security. According to the DOJ, the AI innovation happening at the Colossus cluster supports critical operations for the Department of War, making the continuous operation of the supercomputer a matter of national interest.
Mississippi environmental regulators did grant a permit for 41 permanent gas-fired turbines at the site back in March. However, that permit does not cover the 59 mobile turbines currently operating off-grid, leaving the community stuck in a legal loophole while breathing in heavy industrial exhaust.
